By completing your purchase with The Elderberry Clinic and The Vital Force Healing Academy (“we,” “us,” “our”), you acknowledge that you have read, understood, and agree to be legally bound by the following Terms & Conditions. If you do not agree, do not proceed with your purchase.

1. Educational Purpose Only / No Guarantees

All products, programs, courses, trainings, consultations, certifications, materials, and content provided by The Vital Force Healing Academy are educational and informational only.

We make no guarantees or promises regarding outcomes, income, health results, certifications, licensure, employment, business success, client acquisition, or professional recognition.

Any certificate, credential, or designation issued by The Vital Force Healing Academy is awarded only after:

Completion of the full program term

Full payment of all fees owed

Submission and passing of all required coursework, assessments, and evaluations

You acknowledge and agree that:

Our programs are not state-licensed medical, naturopathic, or healthcare degrees unless explicitly stated in writing.

You are solely responsible for determining how (or if) any education, title, or certificate applies within your local, state, provincial, or national laws and scope of practice.

We do not guarantee that any program meets licensing, insurance, regulatory, or professional requirements in your jurisdiction.

Your results will vary. You assume full responsibility for your decisions, actions, implementations, and outcomes.

2. No Medical, Legal, or Professional Advice

Nothing provided by The Vital Force Healing Academy constitutes medical, diagnostic, legal, financial, or professional advice.

Our services do not replace care from licensed medical or healthcare professionals.

You agree to:

Consult appropriate licensed professionals before making medical, legal, or regulatory decisions

Assume all risks associated with applying or interpreting any information provided.

3. No Refund Policy – ALL SALES FINAL

ALL SALES ARE FINAL.

No refunds, exchanges, credits, charge reversals, or cancellations are provided under any circumstances.

This policy applies to all offerings, including but not limited to:

Digital courses

Memberships

Payment plans

Certifications

Consultations

Live or recorded trainings

Bonuses or additional materials

Failure to complete the program, lack of participation, dissatisfaction, financial hardship, illness, personal circumstances, or misunderstanding of program content does not entitle you to a refund.

By completing your purchase, you expressly waive any right to a refund, regardless of payment method.

4. Payment Plans & Financial Obligation

If you enroll using a payment plan:

You agree to pay the full program price, regardless of participation, completion, or satisfaction

Payment plans are not subscriptions and cannot be canceled

Missed, declined, or failed payments may result in immediate loss of access while the financial obligation remains fully due

We reserve the right to:

Charge any payment method on file

Require immediate payment of the remaining balance

Restrict access until the account is brought current

5. Chargebacks, Payment Disputes & Collections

You agree not to initiate any chargeback, payment dispute, or payment reversal with your bank, credit card provider, or payment processor.

If you initiate or attempt a chargeback or dispute for any reason:

You will be deemed in material breach of this agreement

Any access granted may be immediately revoked without notice

You agree to be responsible for:

The full outstanding balance owed

All chargeback or dispute fees

Administrative costs

Collection agency fees

Court costs, filing fees, and allowable legal expenses

We reserve the right to:

Submit all documentation to contest any dispute

Refer the debt to a collection agency

Report the debt where legally permitted

Pursue recovery through small claims court or civil court

6. Access, Conduct & Termination

We reserve the right to suspend or terminate access without refund if you:

Violate these Terms

Engage in harassment, defamation, or disruptive behavior

Share, resell, reproduce, or distribute course materials

Attempt to undermine the program, community, or staff

Termination does not relieve you of any financial obligations owed.

7. Intellectual Property

All content, materials, recordings, frameworks, curriculum, trademarks, and proprietary methods are the exclusive intellectual property of The Elderberry Clinic and The Vital Force Healing Academy.

You may not copy, reproduce, distribute, teach, license, or resell any materials without prior written consent.

Violation of this clause may result in legal action.

8. Limitation of Liability

To the fullest extent permitted by law:

We are not liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from your participation

You release and hold harmless The Elderberry Clinic and The Vital Force Healing Academy from all claims, losses, injuries, or damages

Our total liability, if any, shall not exceed the amount you paid for the program.

9. Binding Agreement & Waiver of Claims

By completing your purchase, you acknowledge that:

You have read and understood these Terms & Conditions

This constitutes a legally binding contract

You waive any right to dispute payments outside of these Terms

10. Governing Law, Venue & Arbitration (Optional but Strongly Recommended)

This agreement shall be governed by the laws of the state in which The Vital Force Healing Academy operates.

Any disputes shall be resolved in a court of competent jurisdiction within that state or, at our discretion, through binding arbitration.

11. Modifications

We reserve the right to update or modify these Terms at any time.
The version in effect at the time of purchase governs your transaction.
